SECTION 1: AGREEMENT SCOPE AND CONTEXT
- Term of this Agreement:
I understand that this Activity and Participation Agreement forms the primary understanding between the parties regarding participation in Real Education Events, referred herein as Activity, and works alongside the following documents:
- Privacy Policy
- Medical History Agreement
- Enrolment Terms and Conditions
- Agreement Relationship and Validity
This Agreement is intended to operate in conjunction with other documents provided by Real Education. Certain provisions may be referenced or restated across multiple documents for the purpose of reinforcement and clarity. Such repetition is not intended to create inconsistency, nor does it confer priority or override unless explicitly stated. This Agreement, together with any related documents, shall remain valid and enforceable for the duration of my involvement in any Real Education event.
- Definitions
I understand at all times “Global Educational Events Pty Ltd, Real Education Accelerated Learning” is herein referred to as Providers, and “its Directors, Shareholders, representatives, facilitators, volunteers, crew, servants, and agents” are herein referred to as representatives.
- Invitation
I acknowledge that it is with the Elders of our Land and with Murray Masarik’s consent that I am welcomed to Real Education’s private unique gathering, to be held on the land where the Aboriginal people of the Gubbi Gubbi Nation have lived for thousands of years. I am invited to join in ceremony at this special place, at this special time, for my own awakening.
SECTION 2: PARTICIPATION AND RESPONSIBILITIES
- Accurate Declaration
I confirm that all information provided in this and all other forms, documents, and agreements are complete, accurate, and truthful. I acknowledge that failure to disclose relevant and necessary information may result in serious harm to myself, fellow participants, or the event’s overall integrity.
- Participation
I consent to participating in the Activity and agree to take full responsibility for my engagement and well-being. I will actively engage in the Providers’ processes to support my healing, explore and resolve unsupportive patterns and behaviours, and develop a model of behaviour that aligns with my identity. I understand that participants are encouraged to take part in every activity, process, game, and ritual at a level they feel comfortable with, recognising that greater participation often leads to deeper benefits and insights. I acknowledge that my participation in any specific activity is voluntary, and I have the right to decline any exercise based on my personal discernment. I understand that support will be provided by the experienced crew, ensuring a safe and understanding environment.
- Methodology
I acknowledge that the Real Education Philosophy and Processing Methods are designed to heighten emotions and require my physical participation. I understand that I may be invited to review my past and, in some instances, re-enact situations to support the process.
8. Self-Responsibility
I understand that it is a condition of my participation in this Activity to take responsibility for my own personal welfare, well-being, health, and safety, including responsibility for administering any medication and managing any allergies I may have.
9. Compliance
I acknowledge that for my safety and the safety of others, I must observe and follow instructions and directions at all times. If I fail to do so, the Providers and their representatives have the right to ask me to leave the premises or facilities and to cease participating in the Activity.
10. Drug & Alcohol Free
I agree that I will remain free from, and not be under the influence of, any alcohol, drugs, or mind-altering substances with the exception of prescription medication, for the duration of the Activity, including upon arrival at registration.
SECTION 3: INDEMNITY, RISK, AND LIABILITY
11. Indemnity
I agree to release, absolve, and indemnify the Providers and their representatives from any liability, claims, or actions arising out of or related to my participation in the Activity, including but not limited to injury, illness, loss, damage, or death, whether caused by negligence, breach of contract, or any other act or omission to the fullest extent permitted by law. I understand and agree that this release applies to all claims, including those arising before, during, and after the Activity. I further agree to indemnify the Providers and their representatives against any claims made by third parties as a result of my actions, negligence, or failure to follow instructions during the Activity. If any part of this clause is found to be invalid or unenforceable by law, the remaining provisions shall continue in full force and effect.
12. Risk Acknowledgment
I understand and voluntarily assume the inherent risks of participating in the Activity. These risks may include injury, emotional or physical distress, or property damage. I confirm that I hold sufficient insurance coverage, including Life, Total & Permanent Disability, Income Protection, and Trauma insurance.
13. Medical Disclaimer
If I choose to leave the Activity to seek medical attention for a physical injury, I acknowledge that the Providers are not liable to refund or credit any monies paid. I further understand that any future workshop, service, or event I wish to attend will be billed as a separate item and is not transferable or covered by fees paid for the current workshop.
SECTION 4: EVENT PROCESSES AND CONDUCT
14. Recording and Photography
I acknowledge that the Activity may be filmed, audio recorded, or photographed by the Providers. I understand and agree that any recordings or images taken during the Activity may be used by the Providers for promotional, educational, editorial, security, or archival purposes without compensation or further notice to me. I further agree that this consent is granted in perpetuity and cannot be revoked, withdrawn, or cancelled. The Providers retain full ownership of the recordings and images, and I waive any claims to rights, royalties, or compensation in connection with their use.
15. Rights Reserved
I acknowledge that the Providers and their representatives have the authority to refuse me entry, terminate this Agreement, or cancel my participation due to health concerns, behaviour, or other factors.
16. Accessibility and Support Requirements
If you are legally blind or have a physical disability, we will require your own personal assistant at your own expense, that will have to enrol into the event. Real have to assess your participation in this event. Due to the nature of our events and our venue format we are unable to cater for anyone who has major physical disabilities for example, wheelchair.
17. No Solicitation
I confirm that I will not solicit business from any participant, crew member, or graduate during or after the Activity, including via social media.
18. Copyright
I understand that my participation in the Activity does not entitle me to teach, reproduce, or attempt to replicate any part of the Activity.
19. Confidentiality:
I agree to maintain the confidentiality of the Activity and its processes, ensuring that content discussed during the Activity is not shared with those outsides of the event.
20. Lost Property
I agree that Real Education will hold my lost property for seven days. If unclaimed, it will be donated to charity, and I agree to cover postal and administrative fees if the property is returned to me.
SECTION 5: LEGAL AND CONSUMER PROTECTIONS
19. Rights of a Consumer
I understand that nothing in this Agreement excludes or limits any of my rights under the Fair Trading Act or the Competition and Consumer Act 2010 (Cth). My statutory rights are fully protected.
20. Governing Law and Jurisdiction
I agree that this Agreement is governed by the laws of Queensland, Australia. I submit to the jurisdiction of Queensland courts and waive any objection to the venue.
21. Natural Disasters and Force Majeure Events
I understand that the Providers are not liable for any injury, illness, damage, or loss which includes event fees, travel expenses, or accommodation arising from natural disasters, acts of God, war, government-imposed restrictions or emergencies, public health crises including pandemics or epidemics, or other events beyond their control. At the sole discretion of the Providers, the event may be rescheduled. However, the Providers are under no obligation to do so. I understand that event fees are non-refundable if I choose to leave the event once it has commenced and before its completion. If any portion of this clause is deemed invalid or unenforceable, the remaining provisions shall continue to apply.
22. Amendments and Variations
I understand that the Providers may update or amend this Agreement. I will be notified of significant changes before the start of the Activity.
23. Severability
I agree that if any provision of this Agreement is found to be invalid or unenforceable by law, the remainder of the Agreement will continue to apply.
